EVENT RELEASE & WAIVER OF LIABILITY
I understand that by purchasing any ticket(s) for the BIG FIRE COMEDY FESTIVAL (the “Event") I will expose myself and my guests to risks of serious injury or harm associated with nature, musical events, and social activities in general. I affirm I am physically able to participate in the Event and in any associated activity or performance, and that I have not been advised otherwise by a qualified medical professional. I voluntarily assume any and all risks, known or unknown, associated with my participation in the Event and actions and undertakings in connection with the Event. I acknowledge that my participation may present certain risks to me, and I hereby assume any and all risks associated therewith, including, without limitation, the risk of physical or mental or emotional injury, minor and/or severe bodily harm, and/or illness, which arise by any means, including, without limitation: acts, omissions, recommendations or advice given by Big Fire and/or its agents, employees, or other persons or entities affiliated with the Event; participation in inherently dangerous activities, latent or apparent defects or conditions in any equipment used in the Event; weather or other natural conditions; human error; my physical and mental condition; my own acts or omissions; first-aid, emergency treatment or other services rendered to me or others. I further certify that I am physically able to participate in the Event, and will further hold Big Fire harmless for any injury sustained in the course of this event due to any physical defect or condition that I may have, whether now known or hereinafter discovered.
I for myself, my heirs, personal representatives or assigns, do hereby voluntarily and knowingly, release, discharge and relinquish any and all claims, actions and lawsuits of any kind against Big Fire Comedy Festival, LLC (collectively “Big Fire"), and to its licensees, assignees, and other successors-in-interest all rights of every kind and character whatsoever in perpetuity, related to or arising from my participation in the Event, including, but not limited to, any claims, actions or lawsuits for wrongful death, negligence and/or other fault, either active or passive, and personal injury. I acknowledge that I may hereafter discover claims in addition to the ones released in this document, and I hereby release the Big Fire from any such unknown and/or unsuspected claims. I acknowledge and agree that this waiver is an essential and material term of this agreement, and without such waiver the Big Fire would not have permitted me to participate in the Event.
I agree to hold harmless and indemnify Big Fire against any claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney's fees, damages or other claims for injuries or losses of any kind suffered by me or any others directly or indirectly arising out of involvement in the Event.
I consent to have medical treatment that may be deemed advisable in the event of injury, accident, and/or illness during any program, event, or activity at the Event. I release Big Fire, and all persons participating in any such medical treatment from all responsibility for any such actions.
I understand and agree that the use of any and all photographs and video taken of me at the Event may be used by Big Fire for any promotional purposes, or any other uses without further consent or notification. I further understand and agree that I have no right to sell, transfer, license, sublicense, or any photographs or video taken by me to any other party, except for personal use.
I agree that Big Fire is not liable for acts of God, the weather, strikes, protests, or actions taken by government agencies and similar causes. I understand that tickets are nonrefundable even if the Event is terminated early or canceled, or entry conditions are modified, due to harsh weather, acts of nature, governmental regulation, the failure to obtain required governmental permits, or conditions beyond Big Fire's control.
I agree that this Event Release and Waiver of Liability shall be construed and interpreted according to the laws of the state of California and that the release and agree that the waiver of liability herein will be construed to the maximum allowed by such law.
